These Terms of Use (“Terms”) govern your access to and use of MesaFlow (the “Service”), a platform that lets restaurants turn their tables into self-service ordering points using NFC tags and a web menu. By creating an account, tapping a tag, or otherwise using the Service, you agree to these Terms.
1. Who these Terms apply to
The Service is used by two kinds of people: Operators (restaurants and their staff who set up menus, tables, and tags) and Guests(diners who tap a table’s tag to browse the menu and place orders). Some sections below apply only to one group; where that is the case it is stated.
2. Accounts and access
- Operator accounts are created by invitation and secured with a password. You are responsible for keeping credentials confidential and for all activity under your account.
- Staff roles (owner, manager, waiter and others) determine what each user can see and do. Operators are responsible for assigning roles appropriately.
- Guests do not need an account. Tapping a table tag opens that restaurant’s menu for that specific table with no login required.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to clone, forge, tamper with, or bypass the cryptographic verification on NFC tags;
- Interfere with, disrupt, probe, or overload the Service or its infrastructure;
- Reverse engineer or attempt to extract source code except to the extent the law permits; or
- Upload content that is illegal, infringing, or that you do not have the right to use.
4. Orders and payments
Orders placed through the Service are between the Guest and the Operator. MesaFlow provides the software that transmits an order to the Operator’s kitchen and floor; it is not a party to the sale, does not prepare food, and does not guarantee availability, pricing, or fulfilment. Operators are responsible for the accuracy of their menus, prices, allergen information, and for honoring orders they accept.
5. Operator content
Operators retain ownership of the menus, item names, descriptions, images, branding, and other content they upload (“Operator Content”). Operators grant MesaFlow a limited license to host, display, and transmit that content solely to provide the Service. Operators are responsible for having the rights to all content they upload.
6. Service availability
We work to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features, and may suspend or terminate access where an account violates these Terms or where a restaurant’s subscription lapses or is terminated.
7. Disclaimers and liability
The Service is provided “as is” without warranties of any kind to the maximum extent permitted by law. To the extent permitted by law, MesaFlow is not liable for indirect, incidental, or consequential damages, or for lost profits, revenue, or data arising from your use of the Service.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the “Last updated” date above, and continued use of the Service after changes take effect constitutes acceptance.
